Emergency Rule for Lakes Permits Adopted

Emergency Rule 220­-6­-.55-.153ER, Lakes Permit Regulation, was adopted on Sept. 20, 2006, by the Alabama Department of Conservation and Natural Resources. This rule was adopted regarding the implementation and enforcement of Act 2006-398, which prohibits and/or regulates the operation of certain vessels on Lake Harris (Lake Wedowee), Lake Martin, and Weiss Lake, in Alabama.

A growing concern for clean water and other environmental issues, such as marine sewage and litter disposal prompted the Alabama Legislature to pass Marine Sanitation Act 2002-59 in 2002 to combat health and environmental problems. The act, regulating sewage discharge from recreational vessels and residence boats, became effective Jan. 1, 2003.

During the 2006 legislative session, lawmakers passed Act 2006-398 as an addition to the marine sanitation law, applying only to Lake R.L. Harris (Lake Wedowee), Lake Martin, and Weiss Lake.

The new regulation, signed by Alabama Department of Conservation and Natural Resources Commissioner M. Barnett Lawley, is adopted to comply with the provisions of Act 2006-398 requiring the Department of Conservation and Natural Resources to adopt rules authorizing permits for certain vessels prohibited by the act.

Permits for Vessels on Lake Harris (Lake Wedowee), Lake Martin, and Weiss Lake

Permits shall be issued on a “per lake” basis. Permits shall not be issued until on or about Jan. 1, 2007, or as soon as reasonably practical thereafter. The cost of each annual permit shall be $45. Required Marine Sanitation Inspections will be conducted at no additional charge until Oct. 1, 2008.
